Context : In a recent judgement, the Supreme Court upheld the right to peaceful protest against the law but said that public ways and public spaces cannot be occupied indefinitely. The court felt that the right of the protester has to be balanced with the right of the commuter.

Constitutional Provisions with respect to Right to Peaceful Protests:

  • The Constitution through Article 19(1)(a) guarantees the freedom of speech and expression.
  • Moreover, Article 19(2) of the Constitution guarantees the right to assemble peacefully without arms.
  • Peaceful protests are a cornerstone of democratic countries such as India. It allows citizens to highlight their grievances against the government/issue and are thus part of the democratic functioning of the state.
